The processor shall immediately inform the controller of any breach of this data processing agreement or of accidental, unlawful or non-unlawful access to personal data, the use or disclosure of personal data or a breach of the integrity of personal data, or that the personal data may have been compromised. The processor shall provide the controller with all the information necessary to enable the controller to comply with current data protection legislation and so that the controller can respond to all requests from the competent data protection authorities. It is the responsibility of the controller to inform the competent data protection authority of inconsistencies in accordance with current legislation. The processor must comply with all provisions relating to the protection of personal data set out in this Data Processing Agreement and in the applicable data protection laws relevant to the processing of personal data. The subcontractor has the right to use subcontractors and the controller accepts the use of subcontractors. A list of pre-approved subcontractors is available at the SuperOffice Trust Center. The processor shall ensure, by written agreement with a processor, that any processing of personal data by subcontractors is subject to the same obligations and restrictions as those imposed on the processor under this data processing agreement. The contractual principles of this document have been developed with the International Contract and Commercial Management Association (IACCM) and are supported by it and are called “IACCM Contracting Principles”. They will serve as guidelines adopted by industry to support either the development of applicable contractual clauses or the negotiation of current terms between a supplier and a customer. These principles aim to reduce or eliminate the need for negotiation on these issues and to reduce the cycle time until signature. Participants who agree to these IACCM Contractual Principles are free to use them on a case-by-case basis and as you deem appropriate. However, the benefits of their use should be maximized if both parties agree to make a transaction, to rely on it and to design the corresponding clauses accordingly.
